Conditions and Disclaimers

 | Resources | Forum | Bazaar | Bookstore | Mail List |

The De Bellis Bazaar's Classifieds page is offered as a service to DBx gamers at no cost subject to the following conditions and disclaimers:

  • Acceptable postings will be in either plain ASCII or HTML format and should generally be no more than 250 words in length. Graphics/images, etc. are not acceptable. Postings may include hyperlinks to the poster's own e-mail or web URL addresses.

  • Neither Chris Brantley (hereinafter the "Pagekeeper") nor Levelbest Communications. (i.e., the ISP provider for Fanaticus) can assume any responsibility or liability for injury resulting from reliance on information posted in a Classified notice. No express or implied warranties or guarantees are made regarding any DBA-related products or goods advertised through the Classifieds. The author of the notice is responsible for all representations made in the notice and any consequences resulting therefrom.

  • The Pagekeeper makes no representations regarding the amount of time required to publish a submitted posting on the Classifieds page. Normally postings will be acknowledged and published as they are received, but a variety of circumstances may delay publication of a posting by days or even weeks.

  • Postings not related to DBA and the DBx family of rules are not germane and may be declined by the Pagekeeper in his sole discretion.

  • Postings which are deemed inappropriate and/or which are excessive in length may be declined by the Pagekeeper in his sole discretion.

  • The Pagekeeper reserves the right to edit postings for purposes of spelling, grammar, or format and to remove objectionable material.

  • Individuals submitting a posting consent to inclusion of their e-mail address in the notice for purposes of direct correspondence between readers and the notice poster. Fanaticus will not collect or sell user e-mail addresses for commercial purposes.

  • Purchases and trades arranged through the Classifieds are done so at the sole risk of the traders involved. Fanaticus will make no representations regarding Good or Bad Trader status or otherwise intermediate between traders. The principle of "caveat emptor" (or buyer beware) prevails.

  • When posting a notice regarding a DBA army or figures available for sale or trade, the notice should indicate the number, scale and type of figures, the figure manufacturer (including range/blister numbers where available), a good faith characterization of the quality of the paint job (on a scale of 1-10), and whether the figures are based and flocked. The ad should specify any terms and conditions on the sale or trade offer. The Pagekeeper encourages the practice of linking to (or offering to send by email) a graphical image of any army/figures offered for sale.

  • Postings should contain a specific "kill date" indicating the day and month that the posting can be safely removed by the Pagekeeper. Posters are responsible for notifying the Pagekeeper if a specific posting should be extended beyond its "kill date" and/or should be removed. Otherwise, the Pagekeeper will excercise discretion in determining when to remove notices that he deems to be out of date. The Pagekeeper assumes no responsibility for any harm allegedly suffered due to premature or unreasonably delayed removal of notices.

  • Submission of a notice for posting to brant@erols.com implies familiarity with and acceptance of these Conditions and Disclaimers.

Can you tell I went to law school? Of course, a good lawyer would try to close all the loopholes and would extend this disclaimer with indecipherable text out to 20 pages plus. My purpose here is not so much to protect myself from the rather remote risk of liability, but primarily to make sure that users of the Classifieds understand what they need to do to protect themselves and to reduce the potential for disappointment. An ounce of prevention, etc.
